Welcome to JewelryExchange.App (“Jewelry Exchange,” “we,” “us,” or “our”) online marketplace platform. Jewelry Exchange App operates the online platform via Jewelry Exchange App’s mobile application (the “App”) and website located at www.jewelryexchange.app (the “Site”), which is designed to connect Jewelers with potential clients (each a “Client” and collectively “Clients”) and to facilitate the browsing of jewelry pictures and videos uploaded by jewelers and establish the communication between the consumer and jeweler. We have established this Privacy Policy as a means to describe to you our practices related to the information we collect from users (Jewelers (retailers, manufacturers, designers, assessors and suppliers), Clients, and buyers and sellers of Products) of the Site, App and the online services enabled therein (the “Services”).
So we are clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean information that allows someone to identify or contact you (e.g., your name, address, email address, or telephone number) and any other non-public information that is associated with such information. When we use the phrase “Anonymous Information” in this Privacy Policy, we mean information that is not associated with or linked to your Personal Information, such as aggregated, de-identified data.

YOUR PERSONAL INFORMATION MAY BE PROCESSED BY US IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY. BY USING THE SERVICES AND PROVIDING ANY PERSONAL INFORMATION, YOU ACKNOWLEDGE THE TRANSFER OF DATA FROM YOUR COUNTRY TO A COUNTRY THAT HAS LESS STRINGENT LAWS, AND THE PROCESSING OF YOUR PERSONAL INFORMATION IN CONFORMANCE WITH THIS POLICY.
Note about Children
The Site and App are not directed to children under the age of 18 and children under the age of 18 are not eligible to use our Services. We do not intentionally collect or maintain Personal Information from children under 18 years of age. If we later learn that a person under 18 years of age has submitted Personal Information to us, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the App, Site and the Services.
How We Collect Information
Information You Provide to Us
We collect Personal Information from you in the following ways:
- We collect Personal Information that you submit to us voluntarily when you register for the service and/or use the Services. For example, we will collect your name, email address, address, phone number and password when you register for an account on the Services (an “Account”)].
- If you are a Jeweler, we will collect the information you submit to us to create a profile related to your services (each, a “Profile”), which may include, without limitation, information related to the location of your services, restrictions, specific requirements, and availability. Your Profile and the information therein will be visible to Clients and other users on the Services.
- If you are Jeweler, we collect information about your licenses and certifications, and may require you to provide us with verifiable government-issued identification, as well as electronic copies of your licenses and certifications.
- If you send messages to other users of the Services, we will collect and share those messages with the intended recipient.
- If you have downloaded the App, our App will, with your permission, access and collect information from your calendar, in order to provide you with certain functionalities available as part of the App, such as creating appointments with Consumers or Jewelers.
- If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may collect, store and use that information. If you want to deactivate this feature, you can disable location services on your mobile device.
- When you communicate with us through our Site or App or by sending us an email, we may collect and store any information that is contained in your communications with us. You can choose not to provide us with certain information, but this may limit the features of the App, Site or Services you are able to use.
Information You Provide to Social Networking Sites. The Services allows users to connect certain social networking services to their Account (each, an “SNS”). If you connect your account to your SNS account, we may receive information from the SNS depending on the privacy settings you have with that SNS. Please consult the SNS’s privacy and data practices.
Information Automatically Collected Via Technology
- Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs. For example, some of the information may be collected so that when you visit the Site or the Services again, it will recognize you and the information could then be used to serve advertisements and other information appropriate to your interests.
- Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.
- Pixel Tags. In addition, we use “Pixel Tags” (also referred to as clear Gifs, Web beacons, or Web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, which are used to track online movements of Web users. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in Web pages. Pixel Tags also allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened to ensure that we are sending only messages that are of interest to our users. We may use this information to reduce or eliminate messages sent to a user. We do not tie the information gathered by Pixel Tags to our users’ Personal Information.
- Mobile Device. We may also collect information about your mobile device if you have downloaded the App, including the hardware model, operating system and version, MAC address, unique device identifier, phone number, and mobile network information. In addition, the Services may access your device’s image storage applications, with your consent, to facilitate your use of certain features of the Services. In addition, in the event our App crashes on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our App. This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.
- Analytics Services and Interest-Based Advertising. In addition to the tracking technologies we place, other companies may set their own cookies or similar tools when you visit our Site and App. This includes third party analytics services, including but not limited to Google Analytics (“Analytics Services”), that we engage to help analyze how users use the Services, as well as third parties that deliver content or offers. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve our Services. The information generated by the Cookies or other technologies about your use of our Services (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Policy. By using our Site, App, and Services, you consent to the processing of data about you by Analytics Services in the manner and for the purposes set out above. If you don’t want to take advantage of these services, you may be able to opt-out by visiting http://www.aboutads.info/ or http://networkadvertising.org/choices.
Information Collected by Our Payment Processor. Jewelry Exchange App is FREE for all to download. The Jewelry Exchange App do not accept any payment method.
How We Use Information
Personal Information
In general, we will use your Personal Information to either respond to the requests you make, or to aid us in serving you better. We use your Personal Information to:
- Provide to you the information of the Jeweler that can serve your need;
- Facilitate the creation of your account on our system;
- Provide you with Services and customer support;
- Provide you with information related to the Products and appointments you order or schedule;
- Tailor the features and content of the Services to you;
- Respond to your requests, resolve disputes and/or troubleshoot problems;
- Improve the quality of the App, Site and the Services; and
- Communicate with you about the App, Site and the Services, including appointments booked or purchases made.
Anonymous Information
We may create Anonymous Information records from your Personal Information by excluding information (such as your name) that makes the data personally identifiable to you. We may use Anonymous Information analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. We reserve the right to use Anonymous Information for any purpose and disclose Anonymous Information to third parties in our sole discretion.
How We Disclose Information
We may disclose your Personal Information as described below and as described elsewhere in this Privacy Policy:
- Third Parties Designated by You. When you use the Services, the Personal Information you provide will be shared with the third parties that you authorize to receive such information. For example, if you invite another user to an appointment or calendar meeting, your Personal Information will be made available to them.
- Profile. If you create a Profile, we will share your Profile with Clients and browsers of our Services. The information in your Profile is meant for public consumption, and once displayed on publicly viewable web pages, that information can be collected and used by Clients and other users.
- Third Party Service Providers. We may share your Personal Information with our third party service providers that help us provide Services that we offer you and any other information and data that you provide through your use of the Services.
- Affiliates. We may share some or all of your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), if we have such Affiliates in the future, in which case we will require our Affiliates to honor this Privacy Policy.
- Corporate Restructuring. We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition or dissolution, transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.
- Other Disclosures. Regardless of any choices you make regarding your Personal Information (as described below), we may disclose Personal Information if we believe in good faith that such disclosure is necessary (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on us; (c) to protect or defend our rights or property or other users of the Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our terms of use.
Your Choices Regarding Your Information
- Changing or Deleting your Personal Information. You can review and/or change certain of your Personal Information by logging into the Site or the App and accessing your Account. We may limit the Personal Information you can change on the Site or App. Upon your request, we will deactivate your Account. We may retain your Personal Information to comply with laws, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.
- Application. You can stop all collection of information by the App by uninstalling the App. You may use the standard uninstall process as may be available as part of your mobile device or via the mobile application marketplace or network.
- Email Communications. We will periodically send you free newsletters and e-mails that directly promote the use of our Site, App or Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below). Despite your indicated e-mail preferences, we may send you service related communications, including notices of any updates to our Terms of Use or Privacy Policy.
- Cookies. If you decide at any time that you no longer wish to accept Cookies from our Services for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, however, you may not be able to use all portions of the Services or all functionality of the Services. Information Disclosed to Third Parties
This Privacy Policy addresses only our use and disclosure of information we collect from and/or about you on the Site and Services. If you disclose information to others, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.
The Site may contain content or links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site. During this process, another entity may collect Personal Information or Anonymous Information from you. The Site may also contain links to other websites controlled by us but which operates under different privacy policies. Please review the privacy policy of any new site you visit.
Changes to this Privacy Policy
This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your Personal Information, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our Site and App. Any changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our Site and App. These changes will be effective immediately for new users of our Services. Please note that at all times you are responsible for updating your Personal Information to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice. If you do not wish to permit changes in our use of your Personal Information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us. Continued use of our Site or Services, following notice of such changes shall indicate your acknowledgement of such changes.
